These Terms govern your use of the Heirloom mobile application (“App”), provided by Ali3N Studios LLC (“we,” “us,” or “our”). By using the App you agree to them. If you do not agree, do not use the App.
1. What Heirloom Does
Heirloom repairs damaged photographs: tears, creases, water damage, stains, fading, colour shift, low resolution, and printed halftone scans. You upload a photograph, choose what you want done, and receive a restored copy.
2. Restoration Versus Reconstruction — Please Read This Section
This is the most important thing to understand about the App, and it is the reason we built it.
Where a photograph still holds recoverable detail, Heirloom recovers it. Where it does not, the missing detail is rebuilt by a model — and a rebuilt face is a plausible face, not a record of what someone looked like.
Every result is labelled:
- Faithful restoration — damage was repaired and detail recovered from your photograph.
- Partial reconstruction — most of the result came from your photograph, but some regions held no recoverable detail and were rebuilt.
- Reimagined — the original did not hold enough detail to recover. The result is an interpretation of what the photograph may have shown.
Anything other than “Faithful restoration” contains regions that were invented. They will look convincing. Do not rely on a partial or reimagined result as evidence of a person’s appearance or identity, as proof of any historical fact, or for any legal, genealogical, forensic or identification purpose.
Printed newspaper and magazine images deserve particular caution. The printing process destroys facial detail before any scan is made, so faces in those results are frequently reconstructed rather than recovered.
3. What Heirloom Will Not Do
The App is a restoration tool, not a photo editor. It refuses, and will decline:
- Retouching or beautifying living people
- Altering anyone’s face, body shape or clothing
- Adding or removing people or objects
- Changing a person’s apparent age or identity
- Anything sexualised or suggestive
- Anything that is not the repair of a damaged photograph
These limits are enforced by the service, not merely requested.
4. Photographs of Children
Photographs of children are accepted. They are among the most treasured and most damaged photographs people own.
When the App detects that a child appears in a photograph, it restricts itself to repair operations and the free-text request field is unavailable; the standard restoration presets remain fully available. This is a property of how the photograph is processed, not a judgement about you.
5. Prohibited Uses
You must not upload unlawful material, sexual or explicit content, or content depicting the abuse or exploitation of any person. You must not attempt to use the App to alter a person’s body, clothing, apparent age or identity, or to create misleading imagery of a real person. Every upload is checked automatically, and we may suspend or terminate any account used in breach of this section.
6. Your Photographs and Your Rights In Them
You must own the photographs you upload, or have permission to use them. You keep all rights in them. We claim none. We do not use your photographs to train any model, and we do not sell, publish or license them. You grant us only the limited permission needed to process a photograph in order to restore it for you, as described in our Privacy Policy.
Your original file on your own device is never modified. A restored photograph is always saved as a new file.
7. Credits and Payment
- Restorations are paid for with credits. Credits never expire.
- There is no subscription. Nothing recurring, nothing to cancel.
- The cost of a restoration is shown before anything runs, and depends on what the photograph needs.
- Credits have no cash value and are not exchangeable for money except where the law requires it.
- Purchases are made through Google Play and are subject to Google’s terms. Refund requests for a purchase are handled by Google Play.
If a photograph genuinely cannot be improved, the restoration is refused and no credit is taken. If a restoration fails for a technical reason, the credit is returned automatically.
8. Free Restorations
New accounts receive three free restorations at full quality, with a small watermark along the bottom edge. The allowance is once per person, not once per installation. Restorations paid for with a credit never carry a watermark.
9. Retention of Your Files
Your original is deleted from our servers as soon as processing finishes. The restored result is kept for a short window — currently seven days — so you can download it again, then deleted automatically. You can delete it sooner from the result screen. Please save anything you want to keep. We are not a storage service and we do not guarantee that a restored file will still be available.
10. Age Requirement
You must be at least 13 years old to use the App, and old enough to form a binding contract where you live.
11. Availability
The App depends on third-party image-processing services. We do not guarantee uninterrupted availability, and features may change or be withdrawn.
12. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Results vary enormously with the condition of the source photograph, and no particular outcome is guaranteed.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALI3N STUDIOS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
14. Indemnification
You agree to indemnify and hold harmless Ali3N Studios LLC from any claim arising out of your use of the App, your breach of these Terms, or your uploading of any photograph you did not have the right to use.
15. Termination
You may stop using the App and delete your account at any time from Settings. We may suspend or terminate access for breach of these Terms, in particular Section 5.
16. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law provisions.
17. Changes to These Terms
We may update these Terms. Material changes will be reflected in the date at the top and, where significant, notified in the App. Continued use after a change constitutes acceptance.
