These Terms of Use ("Terms") govern your use of the Windmill: Softball Pitch Chart app ("Windmill" or "the App") published by Ali3N Studios LLC ("we", "us"). By downloading, installing or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. What Windmill does
Windmill is a charting tool for softball coaches. You enter pitch speeds, pitch types, locations and results by hand, and the App produces reports and summaries from what you entered. Windmill does not measure speed and does not connect to any radar device; every number in a report is only as accurate as what was entered.
2. A coaching aid, not a safety rule
The fatigue indicator compares a pitcher's recent speeds with her earlier speeds in the same game. It is a coaching aid based solely on the numbers entered. It is not medical advice, is not an injury-prevention tool, and does not implement any league's pitch-count or rest rules. Decisions about when a player pitches, rests or sees a medical professional are yours and your organization's.
3. Players' information
You may enter players' names and pitching data, including for players who are minors. You are responsible for having the right to record that information and for following your league's, school's and families' expectations about it, including before you share a report or export file. We never receive this information; see the Privacy Policy.
4. Free games and the one-time unlock
Windmill includes three free charted games. A game counts once it has at least one pitch logged. After that, starting a new game requires a one-time purchase through Google Play. Every game you have already charted stays viewable and exportable whether or not you buy.
The unlock is a one-time purchase, not a subscription, and is tied to the Google account that bought it. Use Restore purchase to recover it on a reinstall or a new phone. Payment, and any refund, is handled by Google Play under Google Play's policies.
We may change what the free trial includes for future versions; a purchase you have already made is not affected.
5. Your data and backups
Your games are stored on your device and, if you enable it, in your own Google backup. You are responsible for keeping backups and exports if your data matters to you. We cannot recover lost data because we never hold a copy.
6. Acceptable use
Do not use the App to break any law, to infringe anyone's rights, or to reverse engineer, resell or redistribute the App except as the law allows.
7. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that reports, charts or indicators are accurate, complete or suitable for any particular decision.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALI3N STUDIOS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
9. Termination
You may stop using the App at any time by uninstalling it. We may stop offering the App; if we do, the App on your phone and the data in it are not affected by that.
10. Changes to these Terms
We may update these Terms. Material changes will be reflected in the date at the top and, where significant, noted in the App. Continued use after a change constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law provisions.
